Information Collection Being Reviewed by the Federal Communications Commission

As part of its continuing effort to reduce paperwork burdens, and as required by the Paperwork Reduction Act (PRA) of 1995, the Federal Communications Commission (FCC or the Commission) invites the general public and other Federal agencies to take this opportunity to comment on the following information collection. Comments are requested concerning: whether the proposed collection of information is necessary for the proper performance of the functions of the Commission, including whether the information shall have practical utility; the accuracy of the Commission's burden estimate; ways to enhance the quality, utility, and clarity of the information collected; ways to minimize the burden of the collection of information on the respondents, including the use of automated collection techniques or other forms of information technology; and ways to further reduce the information collection burden on small business concerns with fewer than 25 employees.

What this rule actually says

The FCC is asking the public for feedback on a paperwork collection it's considering—basically, they want input before they finalize rules about what information they might require companies to report. This is *not* a final regulation yet. It's an early-stage proposal that's still being shaped based on public comment.

Who it applies to

Right now: nobody. This is a comment period, not an active rule.

If a final rule emerges from this process, it *could* affect:

  • Companies collecting customer data in the US (FCC has jurisdiction over communications)
  • Any founder whose product involves phone calls, SMS, email, or internet-based communications with users
  • Products that store or process customer information that the FCC decides must be reported

Unlikely to affect:

  • Founders outside the US (unless they serve US customers)
  • Internal-only tools or enterprise software without customer data collection
  • AI tools that don't interact with telecom or internet infrastructure

What's currently unclear: The full text isn't available, so the exact scope—which AI products trigger this, what data categories matter, what company sizes are exempt—can't be confirmed yet.

What founders need to do

  1. Do nothing immediately (30 minutes). This is proposed only. Check back in 6 months to see if it becomes final.
  1. If you collect customer communications data, monitor this (10 minutes now, then quarterly). Set a calendar reminder to search "FCC paperwork reduction" in Q3 2026 to see if a final rule was published.
  1. Prepare a data inventory (2–3 days). Document what customer data your product collects, how long you keep it, and where it's stored. You'll likely need this for *any* regulation eventually, so it's not wasted effort.
  1. Subscribe to FCC updates or check their website monthly (5 minutes monthly). Look for a Federal Register notice or final rule if this moves forward.
  1. If a final rule is published, read it and assess impact (2–4 hours). You'll know then whether you need to report data to the FCC or change collection practices.

Bottom line

Monitor but don't act yet—this is still in the feedback stage, and the actual scope remains unclear until the FCC publishes final language, likely months away.
